Staal en Fermon beargumenteren dat Facebook op verschillende manieren inbreuk doet op het recht op zelfbeschikking van volkeren en individuen. Het bedrijfsmodel van Facebook is gebaseerd op het instrumentaliseren van haar gebruikers als neo-feodale data-arbeiders. Facebook wordt gebruik voor surveillance doeleinden die massale inbreuk doet op privacy en heeft tevens disproportionele impact op democratische verkiezingen, waarvan de massale verzameling van privegegevens en gerichte campagnes van Cambridge Analytica een recent voorbeeld zijn. Het bedrijf maakt gebruik van racistische algoritmen en adviseert opzettelijk autoritaire regimes, zoals dat van Duterte in de Filippijnen.
Tijdens deze pre-trial (“voorzitting”) introduceren Staal en Fermon de aanklacht tegen Facebook en nodigen ze publiek uit om als mede-aanklagers deel te nemen aan de rechtszaak die zal worden ingediend bij de Mensenrechtenraad van de Verenigde Naties in Genève. Vervolgens worden verschillende getuigen opgeroepen om getuigenis te geven van de toekomst die mogelijk wordt als het proces wordt gewonnen: wat zouden de besluitvormingsstructuren zijn voor bijna drie miljard mede-eigenaren van Facebook? Wordt versleuteling van data gegarandeerd en verbieden we algoritmen? Decentraliseren we servers, of ontmantelen we de infrastructuur van Facebook als geheel, gezien haar grote afhankelijkheid van ontginningsindustrieën?
Collectivize Facebook verkent de ruimte van kunst voor collectieve juridische actie en speculatie. Het nodigt het publiek uit om deel te nemen aan een rechtszaak, maar heeft ook tot doel de verbeeldingskracht te mobiliseren als het gaat om het terugwinnen en collectief besturen van Facebook - en andere multinationale ondernemingen - als gemeenschappelijk eigendom.

With nearly three billion users today, Facebook impacts our social, economic and political lives in an unprecedented way. In response, artist Jonas Staal and human rights lawyer Jan Fermon initiated a collective action lawsuit to force legal recognition of Facebook as a public domain that should be under ownership and control of its users.
Staal and Fermon argue that Facebook infringes upon the right to self-determination of peoples and individuals in various ways. The profit model of Facebook is based on the instrumentalization of users as neo-feudal data workers. Facebook is used in various surveillance capacities that infringe upon privacy and further impacts democratic elections in disproportionate ways, of which data capture and targeted campaigns of Cambridge Analytica are a recent example. The corporation makes use of racist algorithms and willfully advises authoritarian regimes such as that of Duterte in the Philippines.
During this pre-trial, Staal and Fermon introduce the indictment against Facebook and invite the public to join as co-signatories to the lawsuit that will be submitted to the United Nations Human Rights Council in Geneva coming September 2021. Subsequently, various witnesses will be called to testify on the future of Facebook if the trial is won: What would be the decision-making structures for nearly three billion co-owners of Facebook? Will it ensure encryption, and ban algorithms? Do we decentralize servers, or even dismantle its infrastructure as a whole, considering its heavy reliance on extractive industries?
Collectivize Facebook engages the space of art as one of collective legal action and speculation. It invites the public to join a lawsuit, but also aims to mobilize the imagination when it comes to reclaiming and governing Facebook – as well as other multinational corporations – as common ownership.
